Terms of Use

This Terms of Use Agreement ("Agreement") governs your use of the website, AI video/photo production services, educational courses, corporate training programs, and certification services provided by Generation AI, operated by JDG Anton Mariukhnenko — Digital Transformation School of Management ("we", "us", "our", "Generation AI"), registered in Poland at Jana Kazimierza 57/86, 01-248 Warsaw, Poland (NIP: 5214014019).

By accessing or using our website, submitting a request through our forms, or purchasing any of our services (together, the "Service"), you agree to be bound by this Agreement. If you do not agree to these terms, please do not use the Service.

The Service includes:

• Commercial AI video and photo production for brands and businesses (e.g., automotive, fashion, real estate, and other industries);
• Online courses and educational materials in the field of artificial intelligence, photo, and video production;
• Corporate AI training programs for organizations;
• Certification and methodology programs (including ICDTAI/DTMM-related offerings).

Access to certain content or services may require registration, submission of a request form, or sign-in via a third-party platform account such as Google or Facebook ("Third-Party Platform").

Submitting a request through our contact/lead form does not itself create a binding contract. A contract for commercial video/photo production or training services is formed only once we confirm the scope, price, and terms in writing (e.g., by email or signed proposal) and, where applicable, receive payment or a deposit.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice, including updating course content, training formats, or production workflows, provided this does not affect services already contracted and confirmed.

Access to certain courses and materials may require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Access to courses is granted to you personally and may not be transferred to third parties. For corporate training or bulk/team purchases, access terms are agreed upon separately in writing.

All materials available through the Service — including video lessons, presentations, workbooks, texts, methodologies, and other educational content — are the property of Generation AI and are protected by applicable intellectual property laws. You are granted a limited, personal, non-transferable license to view and use these materials solely for your own educational purposes. Copying, distributing, publicly displaying, or reselling any materials without our prior written consent is strictly prohibited.

For commercial video/photo production services, ownership and usage rights of the final delivered materials (e.g., video files, images) are governed by the specific commercial agreement/proposal confirmed with the client for that project. Unless otherwise agreed in writing, Generation AI retains the right to display delivered work in its portfolio, website, and social media for promotional purposes.

You agree not to:

• use the Service for any unlawful purpose or in violation of applicable laws;
• impersonate any person or organization;
• distribute course materials or delivered production work without written permission where such permission is required;
• interfere with or disrupt the operation of the Service;
• violate any applicable export control laws or regulations.

If you are a consumer located in the EU/EEA, you generally have the right to withdraw from a distance contract within 14 days without giving any reason, in accordance with Directive 2011/83/EU.

This right does not apply, in particular, to:

• custom-made or clearly personalized services and deliverables — including bespoke AI video/photo production created to your specifications, once work has begun;
• services that have been fully performed, where you gave prior express consent to immediate performance and acknowledged that you would lose your right of withdrawal upon full performance;
• digital content not supplied on a tangible medium, where delivery has begun with your prior express consent and acknowledgment of the loss of this right.

Where the right of withdrawal applies (e.g., to standard course purchases not yet accessed), you may exercise it by contacting us at the email address in Section 12 within the 14-day period.

Prices, payment terms, and any applicable deposits for commercial production services or corporate training are set out in the individual proposal or invoice issued to you. Except where required by the right of withdrawal (Section 8) or applicable law, fees for services already performed or custom deliverables already produced are non-refundable.

The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee specific learning outcomes or marketing/business results, as these depend on individual effort and circumstances.

To the extent permitted by applicable law, Generation AI and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, goodwill, data, or other intangible losses arising out of or in connection with your use of, or inability to use, the Service. Nothing in this Agreement excludes or limits liability that cannot be excluded or limited under applicable mandatory law (e.g., liability for death, personal injury, or fraud).

You agree to indemnify and hold harmless Generation AI from and against any claims, liabilities, damages, and expenses arising out of your use of the Service or your breach of this Agreement.

This Agreement is governed by and construed in accordance with the laws of Poland, without prejudice to any mandatory consumer protection rules of your country of residence if you are a consumer in the EU/EEA.

If you are an EU consumer, you may also use the EU Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr, to resolve disputes without going to court.

We reserve the right to modify this Agreement at any time. Material changes take effect upon publication on the Service website, and where legally required, we will notify affected users in advance.
